FRL Partner Vincent Rubino Addresses Patent Litigation Surge with Law360

FRL partner Vincent Rubino discussed Lex Machina’s annual patent litigation report with Law360 and the recent surge in U.S. patent litigation. The article examined recent data from Lex Machina highlighting the 4,547 patent suits filed in 2025, the most in any year since 2015.

Vincent explained that changes to the U.S. Patent and Trademark Office’s process for challenging patents under the America Invents Act pushed many patent owners who had been waiting on the sidelines to file last year. He noted, “everyone who had their finger on the trigger pulled it,” and that filings in 2026 are settling back into a more typical pace.

Vincent also spoke to the continued dominance of the Eastern District of Texas as the busiest patent venue in the country, the frequent transfer of cases within the Western District of Texas, and what can be expected with filing decisions moving forward.
