FRL Secures Complete Win at the ITC in Pre-Stretch Braiding Hair Investigation

FRL achieved a complete defense victory at the ITC for a group of 10 respondents in Certain Pre-Stretch Synthetic Braiding Hair and Packaging Thereof (II), Inv. No. 337-TA-1457. Administrative Law Judge Cameron Elliot issued a Final Initial Determination finding all four patents asserted by complainant JBS Hair, Inc. invalid, with no violation found by any respondent, including the 10 FRL represented.

The investigation arose from JBS Hair’s allegations that imported pre-stretched synthetic braiding hair and its packaging infringed its patents in violation of Section 337 of the Tariff Act of 1930. JBS Hair had previously filed a related complaint with the ITC before withdrawing it, then initiated this second proceeding.

Partner Evan Langdon, chair of FRL’s ITC practice, argued the matter and delivered a clean sweep victory for the firm’s clients across every asserted patent. The FRL team also included Joshua Rodriguez, Juan Garcia, and Samantha Fabricant.
