Associate

Joshua W. Rodriguez (Josh) concentrates his practice on Section 337 investigations before the U.S. International Trade Commission (ITC), helping companies and inventors protect their intellectual property and monetize their patent portfolios.

Josh has represented complainants, respondents, and third parties in more than 25 Section 337 investigations involving patents, trade secrets, and false advertising across a wide range of technologies, including electronic eyewear, smartphones and tablets, networking equipment, storage devices, memory devices, electronic displays, LED lighting, lithium-ion batteries, orthodontics devices, nasal irrigation and aspiration devices, and sporting goods. His experience spans every phase of an investigation—from pre-filing due diligence and complaint drafting through fact and expert discovery, hearings, post-trial briefing, and appeal.

Having devoted his practice almost exclusively to ITC litigation, Josh is adept at navigating the forum’s fast-paced schedule and unique procedural requirements, including domestic industry, importation, and complex discovery issues. He regularly manages large-scale discovery, takes and defends depositions, and authors briefing on nuanced legal issues, including case-dispositive motions. Drawing on experience representing parties on all sides of an investigation, Josh develops practical, outcome-oriented strategies tailored to each client’s business and litigation objectives.

Josh’s work and dedication to client success have drawn national recognition. In 2026, Patexia ranked Josh among the top 15 most active attorneys representing complainants and among the top 40 best performing attorneys representing complainants in Section 337 investigations. In addition, Josh has been named in The Best Lawyers: Ones to Watch for intellectual property litigation since 2023, and Chambers USA identified him as a Section 337 “Associate to Watch” in 2021 and 2022. Business Today also included Josh in the “Top 10 Most Influential Section 337 Intellectual Property Lawyers in USA, 2023.”

Before joining Fabricant Rubino & Lambrianakos LLP, Josh practiced in the Section 337 groups at an Am Law 100 firm and a boutique Chambers-ranked litigation firm.

- Representing Complainant Monolithic 3D™ Inc. in a patent infringement investigation involving 3D NAND and HBM DRAM memory chips against SK Hynix and KIOXIA. The investigation is ongoing. Certain NAND and DRAM Memory Chips, USITC Inv. No. 337-TA-____.
- Representing Complainant in a Section 337 patent infringement investigation involving 4G/5G wireless communication devices against Qualcomm, T-Mobile, DISH Wireless, EchoStar, HTC, and LGE, among others. The investigation is ongoing.
- Representing a group of respondents in a patent infringement investigation involving synthetic braiding hair filed by JBS Hair. The investigation is ongoing. Certain Pre-Stretched Synthetic Braiding Hair and Packaging Therefor (II), USITC Inv. No. 337-TA-1457.
- Represented Complainant IngenioSpec, LLC in a patent infringement investigation involving electronic eyewear against DJI, Brilliant Labs, and Even Realities, among others, resulting in seven favorable settlement agreements with respondents before the evidentiary hearing. Certain Electronic Eyewear Products, Components Thereof, and Related Charging Apparatuses (II), USITC Inv. No. 337-TA-1455.
- Represented Complainant Aardvark Medical in a patent infringement investigation involving nasal irrigation devices against RhinoSystems d/b/a Naväge and Spa Sciences, among others, resulting in two favorable settlement agreements with respondents and default judgments against six respondents before the evidentiary hearing. Certain Nasal Devices and Components Thereof, USITC Inv. No. 337-TA-1444.
- Represented Complainant IngenioSpec, LLC in a patent infringement investigation involving electronic eyewear against Meta, Valve, HTC, and ByteDance, resulting in four favorable settlement agreements with respondents before the evidentiary hearing. Certain Electronic Eyewear Products, Components Thereof, and Related Charging Apparatuses, USITC Inv. No. 337-TA-1423.
- Represented a group of respondents in a patent infringement investigation involving synthetic braiding hair filed by JBS Hair, resulting in complainant withdrawing the complaint before the evidentiary hearing. Certain Pre-Stretched Synthetic Braiding Hair and Packaging Therefor, USITC Inv. No. 337-TA-1415.
- Represented Complainant IngenioSpec, LLC in a patent infringement investigation involving electronic eyewear against Luxottica, Magic Leap, and XREAL, among others, resulting in 10 favorable settlement agreements with respondents and a consent order against another respondent before the evidentiary hearing. Certain Electronic Eyewear Products and Components Thereof, USITC Inv. No. 337-TA-1383.
- Represented Complainants Advanced Ground Information Systems, Inc. and AGIS Software Development LLC in a patent infringement investigation involving locations sharing systems against Google and Samsung, among others, resulting in multiple favorable settlements with respondents. Certain Location-Sharing Systems, Related Software, Components Thereof, and Products Containing Same, USITC Inv. No. 337-TA-1347.
- Represented Complainant Easton Diamond Sports, LLC, one of the most recognizable brands in baseball and softball equipment, in a patent infringement investigation involving composite baseball and softball bats, resulting in a favorable settlement agreement with one respondent and an exclusion order against another respondent. Certain Composite Baseball and Softball Bats and Components Thereof, USITC Inv. No. 337-TA-1283.
- Represented Complainant Solas OLED Ltd., the leading owner and licensor of technology focused on the organic light-emitting diode (OLED) market, in a patent infringement investigation involving OLED displays against Samsung and BOE Technology, resulting in a favorable settlement agreement with respondents after the evidentiary hearing. Certain Active Matrix OLED Display Devices and Components Thereof, USITC Inv. No. 337-TA-1243.
- Represented Complainant The Regents of the University of California in a patent infringement investigation involving filament LED technology. The administrative law judge found that the complainant satisfied the economic prong of the domestic industry requirement, setting a precedent for the ITC as a viable venue for universities to enforce their intellectual property rights. Certain Filament Light-Emitting Diodes and Products Containing Same (II), USITC Inv. No. 337-TA-1220.
- Represented Complainants LG Chem, Ltd. and LG Chem Michigan Inc. in a trade secret misappropriation investigation against SK Innovation and SK Battery America, resulting in a default judgment and exclusion orders against respondents based on massive, willful spoliation of evidence. The investigation subsequently settled. Certain Lithium Ion Batteries, Battery Cells, Battery Modules, Battery Packs, Components Thereof, and Processes Therefor, USITC Inv. No. 337-TA-1159.
- Represented a third party served with a subpoena in a patent infringement investigation concerning orthodontics devices, resulting in the subpoena being withdrawn against the client. Certain Dental and Orthodontic Scanners and Software, USITC Inv. No. 337-TA-1144.
- Represented Respondent Myle Vape Inc. in a patent infringement investigation involving electronic nicotine devices, resulting in a favorable settlement agreement for the client before the evidentiary hearing. Certain Electronic Nicotine Delivery Systems and Component Thereof, USITC Inv. No. 337-TA-1139.
- Represented respondents in an investigation based on false advertising and unfair competition under the Lanham Act, resulting in complainants withdrawing the complaint before the evidentiary hearing. Certain Clidinium Bromide and Products Containing Same, USITC Inv. No. 337-TA-1109.
- Represented Complainant BiTMICRO, LLC in a patent infringement investigation against Samsung, SK Hynix, and other downstream respondents, resulting in multiple favorable settlement agreements with respondents.
