Joshua W. Rodriguez (Josh) concentrates his practice on Section 337 investigations before the U.S. International Trade Commission (ITC), helping companies and inventors protect their intellectual property and monetize their patent portfolios.
Josh has represented complainants, respondents, and third parties in more than 25 Section 337 investigations involving patents, trade secrets, and false advertising across a wide range of technologies, including electronic eyewear, smartphones and tablets, networking equipment, storage devices, memory devices, electronic displays, LED lighting, lithium-ion batteries, orthodontics devices, nasal irrigation and aspiration devices, and sporting goods. His experience spans every phase of an investigation—from pre-filing due diligence and complaint drafting through fact and expert discovery, hearings, post-trial briefing, and appeal.
Having devoted his practice almost exclusively to ITC litigation, Josh is adept at navigating the forum’s fast-paced schedule and unique procedural requirements, including domestic industry, importation, and complex discovery issues. He regularly manages large-scale discovery, takes and defends depositions, and authors briefing on nuanced legal issues, including case-dispositive motions. Drawing on experience representing parties on all sides of an investigation, Josh develops practical, outcome-oriented strategies tailored to each client’s business and litigation objectives.
